Supreme Court

Robinhood Derivatives, LLC v. Dreitzer

Supreme Court of the United States, 26-338

Cert petition pending

Petition pending; the response deadline was extended on Oct. 9, 2026 from Oct. 14, 2026 to Nov. 13, 2026 for all respondents. Not yet distributed for conference.

The question

Whether the Commodity Exchange Act preempts Nevada gambling or sports-wagering law as applied to event contracts listed on a CFTC-designated contract market.

Robinhood's derivatives subsidiary asked the Supreme Court to review the Ninth Circuit's Aug. 28, 2026 ruling for Nevada regulators in its preemption challenge. The petition presents the same question as New Jersey's petition in the Kalshi case, from the operator side.
