State of play

  • Two CFTC event-contract rulemakings are open. The June 2026 Rule 40.11/Appendix F public-interest proposal (comments closed July 27) has no final rule yet, and the October 2026 proposal to define event contracts as swaps takes comments for 30 days after its October 19 publication.
  • An interim final rule excluding sportsbook and casino-style wagers from the swap definition took effect October 19, 2026.
  • The circuits are split. The Third Circuit (April 6) ruled for Kalshi on preemption, while the Ninth (August 28) and Sixth (September 25) ruled for Nevada, Ohio and Tennessee. The Fourth Circuit's Maryland appeal, argued May 7, is still pending.
  • In Flaherty v. KalshiEX (No. 26-299), Kalshi's response is due November 9, 2026 and no conference date is set. Ohio, 38 other states and D.C., 145 tribes, the NFL and the AGA filed amicus briefs urging review.
  • The CFTC has sued or intervened against nine states (AZ, CT, IL, KY, MN, NM, NY, RI, WI) and has used emergency authority twice to keep Kalshi trades and operations going (July 14 for Michigan, August 11 for New York).
  • Congress has introduced more than 25 prediction-market bills in 2026 and none has cleared committee. The only adopted measure is S. Res. 708, a Senate rule barring senators and staff from event-contract trading.
