Private civil suit

Georgia Gambling Recovery LLC v. Kalshi Inc., et al.

U.S. District Court for the Middle District of Georgia (removed from the State Court of Muscogee County), 4:25-cv-00310 (consolidated with 4:25-cv-00311); SC2025CV001749 (Muscogee County)

Pending

Judge Clay D. Land denied remand in early February 2026 and kept the case in federal court. After an amended complaint, renewed motions to dismiss were due March 31, 2026. A litigation tracker reports a six-month stay granted May 28, 2026 (not docket-verified).

The question

Whether a third party can use Georgia's gambling-loss recovery law to recover money lost on sports event contracts offered through CFTC-registered exchanges and brokers, or whether federal commodities law displaces the claim.

Georgia Gambling Recovery LLC sued Kalshi entities, Susquehanna, Robinhood and Webull in Muscogee County state court in 2025 to recover gambling losses tied to sports event contracts. The defendants removed the case on Oct. 2, 2025, and in February 2026 Judge Clay Land denied the plaintiff's motion to send it back to state court. The plaintiff amended its complaint in March 2026 and the defendants were due to move to dismiss again. A tracker reports the case was stayed for six months in May 2026. The plaintiff's claims are allegations.
