State v. operator

Derek Brown v. Kalshi Inc.

Utah Third Judicial District Court, Salt Lake County

Pending

Complaint filed Oct. 20, 2026; no ruling or removal reported.

The question

Whether the operator's event contracts are unlicensed gambling under Utah law, or whether federal commodities law preempts the state's claims.

Utah's 63-page complaint alleges that Kalshi's sports, election and cultural contracts are gambling barred by the state constitution and a public nuisance. It asks for geolocation blocking, disgorgement and restitution, and estimates Kalshi took in roughly $30 million to $61 million from Utah accounts; market maker Susquehanna is also a defendant.
