Prediction Market Laws. (2026, October 28). United States v. State of Utah. https://predictionmarketlaws.com/lawsuits/us-v-utah
Complaint filed Oct. 26, 2026 and announced by the CFTC on Oct. 27, 2026; no ruling as of Oct. 28, 2026.
The question
Whether the Commodity Exchange Act preempts Utah's gambling, election-betting and public-nuisance laws as applied to event contracts on CFTC-registered exchanges.
The federal government's one-count Supremacy Clause complaint asks the court to declare Utah's laws preempted as applied to CFTC-registered markets and to bar the state from investigating or enforcing them against those markets and their partners. It names Utah's Oct. 20, 2026 state-court suit against Kalshi as its main target. The CFTC says it has now sued nine other states.
