Operator v. state

KalshiEX LLC v. Bird

U.S. District Court for the Southern District of Iowa, 4:26-cv-00109

Injunction denied

Judge Stephen H. Locher denied Kalshi's motion for a preliminary injunction on Sept. 8, 2026, finding Kalshi unlikely to succeed on its preemption claim; Kalshi filed a notice of interlocutory appeal on Sept. 15, 2026 (8th Cir. No. 26-2874).

The question

Whether the Commodity Exchange Act preempts Iowa gambling or sports-wagering law as applied to event contracts listed on a CFTC-designated contract market.

Kalshi sued Iowa officials to block enforcement of state gambling law against its sports contracts. After briefing that ran through July 2026, the court denied preliminary relief in September and Kalshi appealed.
