United States v. state

United States v. Commonwealth of Kentucky

U.S. District Court for the Eastern District of Kentucky, 3:26-cv-00049

Pending

PI motion withdrawn July 21, 2026 in favor of summary-judgment cross-motions. A Oct. 5, 2026 order (Doc. 67) canceled the Oct. 9, 2026 argument and called for supplemental briefs (15 pages each) by Oct. 23, 2026; no new argument date and no ruling as of Oct. 21, 2026.

The question

Whether the CEA preempts Kentucky law as applied to event contracts on CFTC-registered exchanges, so that the state may be enjoined from enforcing it against them.

The CFTC challenged Kentucky's state-court enforcement suits and a new transaction fee on CFTC-regulated exchanges. Judge S. Chad Meredith allowed the Coalition for Fair Markets to intervene and is deciding the case on summary judgment.
