United States v. state

United States v. State of Arizona

U.S. District Court for the District of Arizona, 2:26-cv-02246

Injunction granted

Consolidated into KalshiEX v. Johnson (2:26-cv-01715); PI granted May 5, 2026. Arizona's appeal (9th Cir. 26-4281) was stayed pending the Nevada appeals; after the Aug. 28, 2026 Nevada ruling, Arizona asked on Sept. 14, 2026 for summary vacatur of the PI as to sports contracts. No ruling found as of Oct. 21, 2026; the PI remains in effect.

The question

Whether the CEA preempts Arizona law as applied to event contracts on CFTC-registered exchanges, so that the state may be enjoined from enforcing it against them.

The federal government sued Arizona as the state pursued civil and criminal enforcement against CFTC-regulated exchanges. It won a TRO and then the first federal-government preliminary injunction in this litigation.
