Prediction Market Laws. (2026, October 21). The Seminole Tribe of Florida v. DraftKings, Inc., et al.. https://predictionmarketlaws.com/lawsuits/seminole-tribe-v-draftkings
Complaint filed Oct. 8, 2026; no rulings reported as of Oct. 21, 2026. DraftKings says its prediction markets operate under the federal Commodity Exchange Act framework and that Pick6 is peer-to-peer fantasy, not sports betting.
The question
Whether DraftKings' sports event contracts and Pick6 product offered in Florida are illegal gambling under Florida law that the Seminole Tribe can enjoin, given the tribe's exclusive 2021 compact and the federal Commodity Exchange Act framework DraftKings invokes.
The Seminole Tribe of Florida sued DraftKings, Inc., its prediction-market unit GUS III LLC (DraftKings Predictions) and CEO Jason Robins in Broward County circuit court on Oct. 8, 2026. The tribe alleges that DraftKings' sports event contracts, launched in Florida in September 2026, together with its Pick6 product and sports offerings in its app, are illegal gambling under Florida law that intrudes on the tribe's exclusive rights under its 2021 compact. The complaint seeks to enjoin illegal gambling under Florida statutes and pleads deceptive-practices claims against all defendants and a Florida RICO claim against Robins. It asks for injunctions, declaratory relief and disgorgement. These are the tribe's allegations; DraftKings says its products are lawful.
Docket timeline
The Seminole Tribe e-filed a complaint in the Seventeenth Judicial Circuit (Broward County) against DraftKings, Inc., Jason Robins and GUS III LLC d/b/a DraftKings Predictions, with counts to enjoin illegal gambling under Florida law, Florida RICO (against Robins) and FDUTPA.
