Operator v. state

QCX LLC v. Campbell

U.S. District Court for the District of Massachusetts, 1:26-cv-10651

Pending

Administratively closed: on March 5, 2026 Judge William G. Young granted a joint motion to stay the case until Kalshi exhausts its state appellate rights in Massachusetts v. Kalshi; the Gaming Commission members were dismissed without prejudice by the same stipulation. The case may be reopened under the stipulation.

The question

Whether the Commodity Exchange Act preempts Massachusetts gambling or sports-wagering law as applied to event contracts listed on a CFTC-designated contract market.

QCX LLC d/b/a Polymarket US sued Massachusetts officials in federal court seeking declaratory and injunctive relief against application of state gambling law to its event contracts. By agreement, the case is on hold until Kalshi's state-court appeal concludes.
