State v. operator
People of the State of New York, by Letitia James v. Gemini Titan, LLC
U.S. District Court for the Southern District of New York (removed from N.Y. Supreme Court, New York County, Index No. 451603/2026), 1:26-cv-03318
Pending
Removed April 22, 2026 and reassigned to Judge Victor Marrero on April 28, 2026 as related to the Coinbase removal. New York's remand motion (filed May 1, 2026) has been fully briefed since June 8, 2026; no remand ruling found as of Oct. 21, 2026.
The question
Whether New York's enforcement suit belongs in federal or state court, and whether New York gambling law can be applied to the operator's event contracts.
New York's Attorney General filed a state-court petition against Gemini Titan, LLC on the same day as its Coinbase petition, alleging unlicensed gambling through event contracts and seeking disgorgement, restitution and treble-profit penalties. Gemini removed the case to federal court the next day, and the state is seeking remand.
