State v. operator

State of Nevada ex rel. Nevada Gaming Control Board v. Blockratize, Inc.

Nevada district court, Carson City (First Judicial District)

Injunction granted

A state-court restraining order was entered Jan. 29, 2026. The case was removed and then remanded on March 2, 2026, and on May 29, 2026 Judge Jason Woodbury granted a preliminary injunction barring Polymarket from offering sports, election and entertainment event contracts in Nevada while the case proceeds. The defendants' appeal of the remand order (9th Cir. No. 26-1343) is pending.

The question

Whether Nevada's enforcement suit belongs in federal or state court, and whether Nevada gambling law can be applied to the operator's event contracts.

Nevada regulators sued Polymarket's parent and U.S. exchange entities in state court and obtained a restraining order in January 2026. The defendants removed the case, but it was sent back to state court, where the judge later granted a preliminary injunction.
