Judge Jason Woodbury ruled from the bench on April 3, 2026 and entered a written preliminary injunction on May 18, 2026 barring Kalshi from sports, election and entertainment contracts in Nevada. After a contempt motion, Kalshi agreed (filed July 23, 2026) to third-party geofencing by Aug. 12, 2026, with $120,000-per-day penalties until it is in place.
The question
Whether the operator's event contracts are unlicensed gambling under Nevada law, or whether federal commodities law preempts the state's claims.
Nevada regulators sued Kalshi in state court once its federal injunction was dissolved. Kalshi removed the case, but the federal court remanded it and the Ninth Circuit refused a stay. The state court then enjoined Kalshi, and regulators pursued contempt over contracts their investigators entered from within Nevada.
