Operator v. state

North American Derivatives Exchange, Inc. v. Hanaway

U.S. District Court for the Western District of Missouri, 4:26-cv-00969

Pending

Complaint filed Oct. 16, 2026 before Judge Greg Kays; only opening filings (pro hac vice motions, mediation-program notice) docketed. No ruling found as of Oct. 21, 2026.

The question

Whether the Commodity Exchange Act preempts Missouri gambling or sports-wagering law as applied to event contracts listed on a CFTC-designated contract market.

North American Derivatives Exchange, Inc. (OG.com) sued Missouri officials in federal court seeking declaratory and injunctive relief against application of state gambling law to its event contracts. It followed Missouri Attorney General cease-and-desist letters sent to six operators on Sept. 16, 2026 and Sept. 17, 2026 (per DeFi Rate).
