State v. operator

Commonwealth of Kentucky v. QCX LLC

U.S. District Court for the Eastern District of Kentucky (removed from Franklin Circuit Court, No. 26-CI-696), 3:26-cv-00047

Pending

On Oct. 14, 2026 Magistrate Judge Edward B. Atkins recommended granting Kentucky's motion to remand to Franklin Circuit Court (the motion was referred to him on Oct. 1, 2026). District Judge Claria Horn Boom had not ruled on the recommendation as of Oct. 21, 2026; objections were due within 14 days of service.

The question

Whether Kentucky's enforcement suit belongs in federal or state court, and whether Kentucky gambling law can be applied to the operator's event contracts.

Kentucky's Attorney General sued Polymarket entities in Franklin Circuit Court under the state Consumer Protection Act, Loss Recovery Act and gambling-device law; the companies removed the case the next day. A magistrate judge has recommended returning it to state court.
