Operator v. state
KalshiEX LLC v. Ellison
U.S. District Court for the District of Minnesota, 0:26-cv-02778
Injunction granted
Judge Katherine M. Menendez granted preliminary injunctions on July 27, 2026 in this case and the related federal and Polymarket US cases; Minnesota may not enforce its new prediction-market ban against the plaintiffs while the cases proceed. No appeal by Minnesota found as of Oct. 21, 2026.
The question
Whether the CEA preempts Minnesota's 2026 law making it a felony to host or advertise prediction markets in the state, as applied to CFTC-registered exchanges.
Kalshi challenged Minnesota's first-of-its-kind prediction-market ban, set to take effect days after the ruling. After a consolidated July 2, 2026 argument, the court issued a 44-page ruling enjoining enforcement, finding the plaintiffs likely to prevail at least in part.
