U.S. Court of Appeals for the Ninth Circuit, 26-4281
Pending
Arizona's appeal of the May 5, 2026 injunction was stayed on July 21, 2026 pending the Nevada appeals. After the Ninth Circuit's Aug. 28, 2026 Nevada ruling, Arizona filed a status report (Sept. 4, 2026) and on Sept. 14, 2026 asked the court to summarily vacate the injunction as it applies to sports contracts. No ruling found as of Oct. 21, 2026.
The question
Whether the preliminary injunction barring Arizona from enforcing its gambling laws against CFTC-regulated exchanges should be vacated in light of Kalshi v. Assad.
Arizona officials appealed the injunction won by the United States and CFTC in the consolidated Kalshi case. Since the Ninth Circuit's Aug. 28, 2026 ruling for Nevada, Arizona has argued the injunction cannot stand; Kalshi and Crypto.com's exchange have appeared to defend it.
